These Terms of Service (“Terms”) govern your access to and use of Host Ri LLC’s websites, products, and services (collectively, the “Services”). By creating an account, placing an order, or using the Services, you agree to be bound by these Terms.

  • Client / You / Your: any person or entity using the Services.

  • Account: your Host Ri client area profile.

  • Order: the purchase of any Service.

  • Content: any data, text, images, code, emails, or materials you store, process, transmit, or publish using the Services.

3) Eligibility & Account Responsibilities

You represent that you are at least the age of majority in your jurisdiction and have authority to enter into these Terms. You are responsible for:

  • maintaining accurate account information;

  • safeguarding login credentials and any 2FA methods;

  • all activity that occurs under your Account.

4) Scope of Services

Host Ri may provide services including (but not limited to) web hosting, domain-related services, SSL certificates, email services, and related tools. Specific features, limits, and pricing are described on our website and/or in your order details. We may update or modify Services from time to time.

5) Acceptable Use Policy (AUP)

You agree not to use the Services to engage in, promote, distribute, or facilitate any activity that is illegal, harmful, or interferes with our network or other customers.

Prohibited Activities include, without limitation:

  • Malware, phishing, fraud, scams, or unauthorized access attempts;

  • Sending spam, unsolicited bulk email, or running open relays;

  • Hosting or distributing content that infringes intellectual property rights;

  • Child sexual abuse material (CSAM) — zero tolerance (immediate suspension and reporting);

  • DDoS attacks, botnets, crypto-mining without explicit permission, or abusive automation;

  • Circumventing resource limits, security controls, or account restrictions.

We may suspend or terminate Services to protect our infrastructure, comply with law, or prevent abuse.

6) Resource Usage & Fair Use

Hosting plans may include resource limits (e.g., CPU, RAM, I/O, inodes, storage, bandwidth, processes). You agree to operate within plan limits and fair-use standards. We may request you upgrade, optimize, reduce usage, or we may apply temporary restrictions to keep services stable for all users.

7) Security & Customer Responsibilities

You are responsible for securing your applications and content, including:

  • updating CMS/plugins/themes and custom code;

  • using strong passwords and 2FA where possible;

  • maintaining secure file permissions;

  • scanning and removing malware if compromised.

If your account is compromised or used for abuse, we may suspend it until the issue is resolved.

8) Backups

Unless a Service explicitly states “managed backups,” backups (if provided) are a courtesy and not guaranteed. You remain responsible for maintaining your own independent backups. Host Ri is not liable for lost data.

9) Payments, Renewals & Billing

You agree to pay all fees associated with your Orders. Unless stated otherwise:

  • Services are billed in advance (monthly/annual/etc.).

  • Renewals may occur automatically (where enabled), using your saved payment method.

  • You are responsible for keeping billing information current.

  • Non-payment may result in suspension and/or termination of Services.

10) Refunds & Money-Back Guarantee

If a money-back guarantee is advertised for a specific Service, it applies only to that Service and only under the posted conditions.

Unless otherwise stated on the order page, domain registrations/transfers, SSL certificates, setup fees, and third-party licenses are generally non-refundable once processed. Refunds are not provided for:

  • violations of the AUP/Terms;

  • abuse-related suspensions/terminations;

  • excessive or repeated refund requests indicating misuse.

11) Chargebacks & Payment Disputes

If you file a chargeback or payment dispute without first contacting us, we may suspend Services and require resolution before reinstatement. We reserve the right to charge reasonable administrative fees and/or require alternative payment methods for future Orders.

12) Domain Name Services

When you register, transfer, or manage a domain through Host Ri, you agree to:

  • provide accurate registrant contact details and keep them updated;

  • comply with applicable registry rules and ICANN policies;

  • acknowledge that domain availability is not guaranteed until confirmed.

Domain actions are often irreversible once submitted to a registry. You are responsible for confirming domain spelling, TLD, and term before purchase.

13) Content & Intellectual Property

You retain ownership of your Content. You grant Host Ri a limited license to host, transmit, and display Content solely to provide the Services.

You represent and warrant that you have all necessary rights to your Content and that it does not violate any law or third-party rights.

14) DMCA / Copyright Complaints

We respond to valid notices of alleged infringement. Repeat infringers may have their Services terminated. If you believe content hosted using our Services infringes your rights, contact support@hostri.com with sufficient details to investigate.

15) Privacy

Your use of the Services is also governed by our Privacy Policy. Where required, you consent to our processing of personal data to provide Services, prevent fraud, and comply with legal obligations.

16) Service Availability & Maintenance

We aim for reliable uptime but do not guarantee uninterrupted service. Scheduled maintenance may occur and may impact availability. We are not liable for downtime caused by:

  • third-party networks/providers;

  • force majeure events;

  • your software/configuration;

  • attacks or emergencies beyond reasonable control.

17) Third-Party Products & Services

Some Services may include or integrate third-party software, certificates, control panels, plugins, or APIs. These may be subject to separate third-party terms. Host Ri is not responsible for third-party outages or changes.

18) Suspension & Termination

We may suspend or terminate Services immediately if:

  • you violate these Terms or the AUP;

  • your use poses a security, legal, or operational risk;

  • required payments are overdue.

You may cancel Services through the client area (where available) or by contacting support. Cancellation stops future renewals; it may not automatically trigger a refund unless eligible under Section 10.

19) Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, Host Ri disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

20) Limitation of Liability

To the maximum extent permitted by law, Host Ri will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business.

To the extent liability is permitted, Host Ri’s total aggregate liability for any claim relating to the Services will not exceed the amount you paid to Host Ri for the affected Service during the three (3) months immediately preceding the event giving rise to the claim.

21) Indemnification

You agree to defend, indemnify, and hold harmless Host Ri from any claims, damages, liabilities, costs, and expenses arising from:

  • your Content;

  • your use of the Services;

  • your violation of these Terms or applicable law;

  • your infringement of third-party rights.

22) Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted on our website, unless stated otherwise. Continued use of the Services after changes means you accept the updated Terms.

23) Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles. Any dispute will be brought in the courts located in New Mexico, unless otherwise required by applicable law.
